Terms and Conditions for GutuCakes
All orders by the customer ("you", "your"), for supply of goods by GutuCakes ("we", "us", "our") are subject to these terms and conditions. Once you have placed your order, and it has been considered firm, there will be a contract between us. The contract will end upon your satisfactory receipt of goods.
1. Order Placement and Confirmation:
a. All cake orders must be placed in writing by you, via email or through messaging our official social media pages.
b. A non-refundable deposit of 20% of the total order cost is required to secure the booking.
c. Orders placed within 28 days of the delivery or pick up date will need to be paid in full to confirm the order.
d. The order will be considered confirmed only upon receipt of the deposit.
e. Wedding cake orders will need to be placed at least 8 weeks in advance.
2. Payment:
a. The remaining balance must be paid in full no later than 28 days before the scheduled delivery or pickup date.
b. Payments can be made through the accepted payment methods on our website.
3. Cancellation and Refunds:
a. In the event of a cancellation within 14 days, any costs incurred for supplies or work completed that exceed the deposit amount will be deducted from the refund.
b. Cancellations made within 7 days of the event are not eligible for a refund of the full payment.
4. Changes to Orders:
a. Changes to the cake design or flavor must be requested in writing (email, text, message on social media platforms) and are subject to written approval.
b. Changes made within 7 days of the event may incur additional charges.
5. Collection, Delivery and Setup:
a. We offer a collection only service with the exception of the following:
- Free local delivery within a 5 mile radius.
- Very large cake orders. Delivery will incur an additional fee, based on the locality and calculated on mileage.
- Wedding cakes.
b. Wedding cakes will always be delivered and set up. We do not accept collection of wedding cakes.
c. You are responsible for ensuring the cake is collected at the agreed-upon collection time.
d. You are responsible for ensuring someone is available to receive the cake at the agreed-upon delivery time.
e. Wedding cakes and very large cakes will have a set up fee starting from £50. We are not responsible for any damages to the cake after setup.
6. Cake Design:
a. Every effort will be made to replicate the agreed-upon design, but slight variations will be made to avoid plagiarism.
b. If any specific decorations or cake toppers are provided by you, you are responsible for ensuring they are food safe and appropriate for the cake. We will not take responsibility of integrity of these.
7. Allergies and Dietary Restrictions:
a. It is your responsibility to inform us of any allergies or dietary restrictions.
b. We cannot guarantee that our cakes are free from allergens, as our kitchen handles common allergens. Please inform us of any severe allergies
8. Force Majeure:
a. We are not liable for any failure or delay in fulfilling our obligations due to circumstances beyond our control, such as natural disasters, acts of war, or other unforeseen events.
9. Dispute Resolution:
a. We kindly ask you to inspect the order upon collection or at delivery.
b. Should you encounter any issues with your order, kindly notify us promptly to facilitate immediate resolution. If a resolution cannot be achieved at that time, we request that you formally communicate the matter to us in writing within 14 days, allowing us the opportunity to thoroughly investigate and provide a comprehensive report.
By placing an order with GutuCakes, the client agrees to these terms and conditions. GutuCakes reserves the right to update or modify these terms at any time, and the client will be notified of any changes.
